The House of Representatives has provided a respite for activist groups by delaying the FY13 House Agriculture Appropriations bill, part of which had a provision that would have handed even more power into the hands of somewhat arbitrary and frequently unknowledgable judges. The “Farmer Assurance Provision” (Section 733) would have eliminated the rights of federal courts to halt the sale and planting of genetically engineered crops that haven't been found to be harmful in any way. All a judge has to do at the current time is make any ruling at all and then ban the product during the legal appeals process, which can take years.
In numerous cases, activists have used the courts to halt the sale and planting of GMO crops while the approval of those crops is under review...not by scientists, that has long been done, but by a federal judge. Supporters of science are calling the Farmer Assurance Provision the Monsanto Protection Act because, if passed, activists would no longer be able to foment anti-science hysteria and irrational use of the precautionary principle .
